At last week’s scheduling hearing, each of the RNC 8 and/or their lawyers met separately with Judge Teresa Warner. Most though not all of the proceedings were off the record. Judge Warner stated that she will be treating the case as eight individual cases until motions of consolidation are filed by either the defense or the prosecution. At this point it appears that the state would prefer the case not be consolidated.

All eight have upcoming motion hearings on discovery issues, with dates ranging from February 24 to March 3. At these hearings, Warner will consider the prosecution’s motion for a protective order regarding discovery, as well as motions filed by the RNC 8 defense team. The current loose timeline calls for the prosecution to complete discovery by the end of March. Possible trial dates in late September were also discussed; it seems that this would be the earliest a trial is likely to begin.
